The FMCSA Drug & Alcohol Clearinghouse has been live since 2020, and it's already the #1 source of CDL-driver violations we see on audit reviews. Not because drivers are testing positive at higher rates โ but because carriers aren't running the queries the regs require.
Three things you owe, on three different schedules:
1. Pre-employment full query
Before you let a new CDL driver behind the wheel, you must run a full query in the Clearinghouse. The query returns the driver's entire violation history โ positive tests, refusals, return-to-duty status, and SAP completion.
The driver has to give consent in the Clearinghouse portal (the carrier can't consent for them). Most new hires haven't created their Clearinghouse account, so this is where carriers get stuck. Build it into your offer-letter workflow: "Create your Clearinghouse account and give Patron consent within 48 hours" alongside the I-9.
Skip this and: any roadside hit shows the missing pre-emp query โ automatic CSA event + civil penalty up to $5,833 per violation.
2. Annual limited query (on every current CDL driver)
Every year, you run a limited query on each CDL driver you employ. The driver consents once (in writing, not in the Clearinghouse) and that covers all limited queries for the year. The query returns "no information found" if their record is clean โ or tells you a full follow-up query is required.
This is the one that gets missed most. It's not driven by any single event, so it slips through. The fix is calendaring it the same way you calendar an annual MVR.
3. Reporting violations
If you have actual knowledge of a driver's drug or alcohol violation (positive test result, refusal to test, on-duty alcohol use, etc.), you must report it to the Clearinghouse within 3 business days. Same for any return-to-duty test you administer.
Late reporting is its own violation. Don't sit on it.
How Patron handles all three

Annual limited queries fire on schedule for every active CDL driver. Positive tests and RTD results get reported within the 3-day window because Patron is your DER on file.
The Clearinghouse is mostly a calendar problem dressed up as a compliance problem. Fix the calendar and the compliance fixes itself.
